Abstract

Abstrak Penelitian ini memiliki tujuan untuk mengetahui Faktor-faktor apa yang membuat pelaku anak melakukan tindak pidana penggelapan kendaraan bermotor dan untuk mengetahui upaya penanggulangan terhadap tindak pidana penggelapan kendaraan bermotor. Metode yang digunakan dalam penelitian ialah yuridis empiris. Hasil penelitiannya ialah faktor-faktor terjadinya tindak pidana penggelapan dalam transaksi sewa-menyewa kendraan bermotor tersebut dapat digolongkan menjadi dua yaitu faktor intern dari pelaku dan faktor ekstern dari pelaku. Faktor dari dalam (intern) yaitu faktor adanya nafsu ingin memiliki barang yang digelapkan dan faktor pemanfaatan adanya kesempatan terjadinya kejahatan penggelapan antara lain: mudahnya percaya pada seseorang, jumlah uang muka dan sewa yang terjangkau. Faktor dari luar (ekstern) yaitu faktor ekonomi dan faktor lingkungan antara lain; faktor lemahnya sistem pengawasan dan kendali. Upaya upaya yang dilakukan oleh pihak Kepolisian Resor Kota Jambi untuk menangani tindak pidana penggelapan kendaraan milik rental dapat dibagi tiga yaitu Mencari Pelaku, melakukan Koordinasi dengan Kepolisian daerah sekitar Kota Jambi dan membantu pihak rental dalam mengembalikan kendaraan yang digelapkan. pihak penyidik untuk mengungkap tindak pidana yang terjadi dan upaya-upaya yang dilakukan sudah dirasa maksimal dan cukup efektif untuk menangani tindak pidana penggelapan yang dimaksud. Kata Kunci: kriminologis, penggelapan kendaraan roda dua, Anak Abstract This study aims to determine what factors make child perpetrators commit the crime of motor vehicle embezzlement and to determine the efforts to overcome the crime of motor vehicle embezzlement. The method used in this research is empirical juridical. The result of the research is that the factors of the occurrence of criminal acts of embezzlement in the motor vehicle rental transactions can be classified into two, namely internal factors from the perpetrators and external factors from the perpetrators. Internal (internal) factors, namely the desire to own the embezzled goods and the use of the opportunity for embezzlement crimes include: easy trust in someone, the amount of down payment and affordable rent. Factors from outside (external), namely economic factors and environmental factors, among others; the weakness of the monitoring and control system. The efforts made by the Jambi City Police to deal with the crime of embezzling rental vehicles can be divided into three, namely looking for perpetrators, coordinating with regional police around Jambi City and assisting rental parties in returning embezzled vehicles. the investigators to uncover the criminal acts that occurred and the efforts made have been deemed maximal and effective enough to deal with the crime of embezzlement in question.
