Abstract
ABSTRAK Penyelesaian perkara pidana melalui kebijakan non penal merupakan konsep pemidanaan dalam sistem peradilan pidana yang dapat ditempuh menggunakan hukum pidana maupun dengan cara diluar hukum pidana atau diluar pengadilan. Adapun salah satu contoh penyelesaian tindak pidana penipuan dengan modus jual beli hewan kerbau melalui kebijakan non penal yang terjadi Di Wilayah Hukum Kepolisian Sektor Rantau Pandan Kabupaten Bungo yaitu berdasarkan Laporan Polisi Nomor: LP/B-05/I/2019/SPKT. Masalah yang diangkat adalah Bagaimanakah Penyelesaian Non Penal Terhadap Tindak Pidana Penipuan Dengan Modus Jual Beli Kerbau Di Kepolisian Sektor Rantau Pandan Kabupaten Bungo, Apakah yang menjadi hambatan Penyelesaian Non Penal Terhadap Tindak Pidana Penipuan Dengan Modus Jual Beli Kerbau Di Kepolisian Sektor Rantau Pandan Kabupaten Bungo, Bagaimanakah upaya mengatasi hambatan Penyelesaian Non Penal Terhadap Tindak Pidana Penipuan Dengan Modus Jual Beli Kerbau Di Kepolisian Sektor Rantau Pandan Kabupaten Bungo. Adapun tipe penelitian ini adalah Yuridis Sosiologis. Di dalam penulisan skripsi ini penulis gunakan model pendekatan penelitian Empiris, sedangkan Socio-Legal Research. Tehnik penentuan materi dilakukan secara materi Purposive Sampling. Penyelesaian terhadap tindak pidana penipuan dengan modus jual beli kerbau yang terjadi Di Kepolisian Sektor Rantau Pandan Kabupaten Bungo telah di selesaikan secara Non Penal berdasarkan Laporan Polisi Nomor: LP/B05/I/2019/SPKT. Sebenarnya penggunaan hukum pidana berupa kurungan penjara dalam penyelesaian kasus tindak pidana penipuan jual beli kerbau tersebut merupakan langkah yang sangat tepat guna memberikan efek jera terhadap diri pelaku. Dalam proses penyelesaian secara Non Penal tindak pidana penipuan dengan modus jual beli kerbau yang terjadi Di Kepolisian Sektor Rantau Pandan Kabupaten Bungo pihak aparat penegak hukum dalam hal ini yaitu Kepolisian Sektor Rantau Pandan tentunya menemui hambatan yaitu adanya permintaan ganti rugi materil (uang) yang diminta pihak pelapor sebagai syarat perdamaian (cabut laporan). Adapun upaya mengatasi hambatan penyelesaian non penal terhadap tindak pidana penipuan dengan modus jual beli kerbau Di Kepolisian Sektor Rantau Pandan Kabupaten Bungo yaitu Penyidik memberikan masukan kepada pelapor bahwa hendaknya uang tersebut dibayarkan secara berangsur terhadap pelapor. Saran yang dikemukakan hendaknya pihak keluarga pelapor mempertimbangkan alasan kemanusiaan dengan tidak memaksa meminta syrat mengganti uang secara langsung megingat dilihat dari kondisi ekonomi Hendro (Terlapor) tersebut tidak mempunyai kemampuan untuk membayarnya secara langsung permintaan pihak pelapor. Kata Kunci : Penyelesaian Non Penal Terhadap Tindak Pidana Penipuan Dengan Modus Jual Beli Kerbau ABSTRACT Settlement of criminal cases through non-penal policies is a concept of punishment in the criminal justice system that can be pursued using criminal law or by means outside of criminal law or outside the court. As for one example of the settlement of a criminal act of fraud with the mode of buying and selling buffalo animals through a non-penal policy that occurred in the Legal Area of the Rantau Pandan Police Sector, Bungo Regency, namely based on the Police Report Number: LP/B-05/I/2019/SPKT. The problem raised is how is the non-penal settlement of the crime of fraud with the buying and selling mode of buffalo in the Rantau Pandan Police, Bungo Regency, what are the obstacles to the non-penal settlement of the crime of fraud with the mode of buying and selling buffalo in the Rantau Pandan Police, Bungo Regency, how Efforts to overcome obstacles to the Non-Penal Settlement of Fraud Crimes with the Buffalo Sale and Purchase Mode in the Rantau Pandan Police Sector, Bungo Regency. The type of this research is Juridical Sociology. In writing this thesis, the author uses an Empirical research approach model, while Socio-Legal Research. The technique of determining the material is done by using purposive sampling. The settlement of the criminal act of fraud with the mode of buying and selling buffalo that occurred in the Rantau Pandan Police of Bungo Regency has been completed non-penally based on the Police Report Number: LP/B-05/I/2019/SPKT. Actually, the use of criminal law in the form of imprisonment in the settlement of cases of fraudulent buying and selling of buffalo is a very appropriate step to provide a deterrent effect on the perpetrators themselves. In the process of non-penal settlement of the criminal act of fraud with the mode of buying and selling buffalo that occurred in the Rantau Pandan Police Sector Bungo Regency, the law enforcement officers in this case namely the Rantau Pandan Sector Police of course encountered obstacles, namely the request for material compensation (money) requested by the parties. reporting party as a condition of reconciliation (revoke report). As for efforts to overcome non-penal settlement barriers against criminal acts of fraud with the mode of buying and selling buffalo in the Rantau Pandan Police Sector Bungo Regency, namely the investigators provide input to the complainant that the money should be paid in stages to the complainant. The suggestion put forward is that the family of the reporting party should consider humanitarian reasons by not forcing them to ask for money to be reimbursed directly considering that Hendro (the Reported Party)'s economic condition does not have the ability to pay directly at the request of the reporting party.
