Abstract

M. Badri, SH, MH Pembimbing II Ahmad Zulfikar, SH, MH) Setiap orang berhak memiliki perlindungan hukum, berhak atas perlakuan hukum yang adil tanpa diskrimasi. Seperti kejahatan tindak pidana pencurian, perlindungan hukumnya harus dilindungi dengan Hak Asasi Manusia (HAM) dan kejahatan terhadap martabat kemanusiaan serta bentuk diskrimasi. Perlindungan hukum terhadap korban juga haruslah ditegakkan terhadap korban seperti pada posisi kasus pencurian bermobus memecah kaca mobil. Tujuan dari penelitian ini adalah Untuk mengetahui perlindungan hukum terhadap korban tindak pidana pencurian dengan modus memecahkan kaca mobil serta mengetahui kendala yang ditemukan dalam memberikan perlindungan hak terhadap korban tindak pidana pencurian. Adapun Tipe Penelitian yang digunakan yaitu penelitian empiris yang bertipe yuridis sosiologis, yaitu merupakan konsep-konsep yang mengidentifikasi hukum sebagai institusi social yang riil dan fungsional dalam system kehidupan bermasyarakat. Berdasarkan Hasil Penelitian Bentuk perlindungan hukum yang di berinya pihak resor kota jambi terhadap korban tindak pidana pencurian, (a) memberikan nomor handphone penyidik (b) rutin memberikan surat hasil penyelidikan kepada korban (c) menjalin akses komunikasi dengan korban (d) mengungkap dan menangkap pelaku kasus tindak pidana pencurian dengan secepatnya. Legal protection for victim must also be enforced againts victims, such as in the case of theft with the motive of breaking car windows. The purpose of this study is to find out the legal protection for victims of the crime of theft by breaking car windows and find out the legal protection for victims of the crime of theft by breaking car windows and find out the obstacles found in providing protection for the rights of victims of the crime of theft. The type of research used is emirical research with sociological juridical type, which are concepts that identify law as a real and funcional social institution in the system of social life.
