Abstract

ABSTRACT Increased cases of environmental pollution and damage caused by forests and land that occurred ini the islands of Sumatra and Kalimantan, including those that occurrred in the Muaro Jambi Regency by individuals and business entities (entities) such as those carried out by PT. Ricky Kurniawan Kertapersada, in the span of August 24, 2015 at the locaton of Block I of Puding Village, Kumpeh subdistrict, covering an area of 602 hectares, caught fire and caught the attention of the community, given the damage to the land, as well as negative impacts and estimated impacts. Thousands of people are exposed to acute respiratory infections, mostly from children who are susceotible to respiratory infections, public health, ground scorched habitat of liars, anti-nutrient drugs, destruction of microorganisms, soil animals, damage to soil texture, rising global temperatures and damage to global cycles hydology, loss of life, forest ecology and the potential for loss of the current displacement. Environmental pollution and demage due to forest and land demage done by individuals or associations, is indeed needed in practice, there have been many perpetrators who have been specifically snared and convicted by goverment. However, if the perpetrators are carried out by the corporations, in their criminal liabilities they are still found in coordination. More entangled and convicted sentenced to individuals (messengers/subordinate level) and has not yet been approved by supported actors/complainants (core management) and weak law enforcement against his partnership. While what is stipulated in article 116 and 119 of Law Number 32 Year 2009, the association can be sentenced to a basic prison sentence in the form of fines and other additional imprisonment which covers all or part on the place of bisiness and/or activity, improvements that are followed up and or whatever is neglected against the destruction of the land.
