Abstract

ABSTRAK Moh. Nazief/ B.19031011[2021 Efektivitas Penerapan Sanksi Pidana Pasal 3 Peraturan Daerah Kabupaten Tebo Nomor 8 Tahun 2014 Tentang Penertiban Dan Pengembangan Ternak. Bila dilihat dari fakta yang terjadi di lapang banyak sekali hewan ternak yang masih berkliaran di Kabupaten Tebo, dimana pada pagi harinya hewan tersebut senggaja dilepas oleh pemiliknya, dampaknya dimana hewan-hewan tersebut banyak yang masuk keperkebunan maupun perkarangan milik warga masyarakat, selain itu ada juga yang berkeliaran dijalan-jalan umum sehingga dampaknya menganggu lalu lintas jalan dan merusak lingkungan akibat dari kotoran hewan-hewan tersebut. Terhadap hal tersebut diatas pada dasarnya telah dilaporkan pada aparat penegak hukum yang berwenang. Secara Yuridis bila dilihat dari Pasal 3 Peraturan Daerah Nomor 8 Tahun 2014 terhadap pemilik hewan tersebut dapat dikenakan pidana kurungan paling lama (tiga) bulan dan denda setinggi-tingginya sebesar Rp. 3.000.000,- Juta Rupiah. Namun dalam kenyataan dari 35 (tiga puluh lima) kasus yang dilaporkan, tidak ada satupun dari kasus tersebut yang ditindak lanjutkan dipersingan Pengadilan.Yang menjadi tujuan penelitian yang ingin dianalisis antara lain: Bagaimankah Efektivitas Terhadap Ketentuan Pasal 3 Perda Nomor 8 Tahun 2014 di Kabupaten Tebo. Faktor Apa Sajakah Yang Menjadi Kendala Dalam Penerapan Ketentuan Pasal 3 Perda Nomor 8 Tahun 2014. Upaya Apa Saja Yang Dilakukan Untuk Mengatasi Kendala Dalam Penerapan Ketentuan Pasal 3 Perda Nomor 8 Tahun 2014 di Kabupaten Tebo. Metode Penelitian, penelitian ini menggunakan Tipe Penelitian Yuridis Empiris. Kemudian Pendekatan yang digunakan antara lain: Pendekatan Perundang-Undangan (Statute Approach), Pendekatan Konseptual (Conceptual Approach). Hasil penelitian ini menunjukkan: 1. Efektivitas Terhadap Ketentuan Pasal 3 Perda Nomor 8 Tahun 2014 di Kabupaten Tebo, belum efektif diterapkan. 2. Faktor Yang Menjadi Kendala Dalam Penerapan Ketentuan Pasal 3 Perda Nomor 8 Tahun 2014 di Kabupaten Tebo antara lain: a. Faktor Aparat/petugas Satpol PP yang dirasakan masih kurang.b. Faktor Sarana dan Prasarana, dimana minimnya kandang untuk penangkaran hewan ternak yang berkeliaran di Kabupaten Tebo. 3. Faktor Masyarakat, dimana masih banyak masyarakat yang tidak memahami peraturan Perda yang berlaku khususnya Perda Nomor 8 Tahun 2014. Upaya Yang Dilakukan Untuk Mengatasi Kendala Dalam Penerapan Ketentuan Pasal 3 Perda Nomor 8 Tahun 2014 di Kabupaten Tebo dimana Pemerintah Kabupaten Tebo akan segera menindaklajuti segala kekurangan yang terjadi dalam penerapan Perda Nomor 8 Tahun 2014. Saran 1. Kepada PemerintahanKabupaten Tebo segera menindaklanjuti segala permasalahan/ kendala yang dihadapi, sehingga penerapan Pasal 3 Perda Nomor 8 Tahun 2014 di Kabupaten Tebo dapat efektif diterapkan.2 Kepada Aparat Satuan Polisi Pamong Praja lebih inten lagi melakukan razia terhadap hewan ternak yang masih berkeliaran. When viewed from the facts that occur in the field, there are many livestock animals that are still roaming in Tebo Regency, where in the morning the animals were accidentally released by their owners, the impact is that many of these animals enter the plantations and yards belonging to the community, besides that there are also that roam public streets so that the impact is disturbing road traffic and damaging the environment due to the feces of these animals.The above matters have basically been reported to the authorized law enforcement officers. Juridically, when viewed from Article 3 of Regional Regulation Number 8 of 2014 the owner of the animal may be subject to a maximum imprisonment of (three) months and a maximum fine of Rp. 3,000,000,- Million Rupiah. However, in reality of the 35 (thirty five) cases reported, none of these cases were followed up by the Court. . What are the factors that become obstacles in the application of the provisions of Article 3 of the Regional Regulation Number 8 of 2014. What are the Efforts to Overcome the Obstacles in the Implementation of the Provisions of Article 3 of the Regional Regulation Number 8 of 2014 in Tebo Regency. Research Methods, this research uses the Juridical Empirical Research Type. Then the approaches used include: the Legislative Approach (Statute Approach), the Conceptual Approach (Conceptual Approach). The results of this study indicate: 1. The effectiveness of the provisions of Article 3 of Regional Regulation Number 8 of 2014 in Tebo Regency, has not been effectively implemented. 2. Factors that become obstacles in the application of the provisions of Article 3 of Regional Regulation Number 8 of 2014 in Tebo Regency include: a. The factors of Satpol PP officers/officers who are felt to be lacking. b. Factors of Facilities and Infrastructure, where the lack of cages for breeding livestock that roam in Tebo Regency. 3. Community Factors, where there are still many people who do not understand the applicable regional regulations, especially Regional Regulation Number 8 of 2014. Efforts Made to Overcome Obstacles in the Implementation of the Provisions of Article 3 of Regional Regulation Number 8 of 2014 in Tebo Regency where the Tebo Regency Government will immediately follow up on all matters shortcomings that occur in the application of Regional Regulation Number 8 of 2014. Suggestions 1. To the Tebo Regency Government to immediately follow up on all problems / obstacles encountered, so that the application of Article 3 of Regional Regulation Number 8 of 2014 in Tebo Regency can be effectively applied. intent on conducting raids on livestock that are still roaming around.
