Abstract

ABSTRACT Many customers using Automated Teller Machines (ATM) cards have experienced problems such as swallowed cards, money that did not come out during withdrawals, and debited accounts. Customers according to Law of the Republic vii of Indonesia Number 10 of 1998 concerning Banking are contained in Article 1 paragraph (16), namely customers are parties who use bank services.The problem raised is what are the rights and obligations of customers and banks regarding withdrawing money from the Automated Teller Machine (ATM) as seen from the agreement at the time of the ATM Card Request Application What is the form of the responsibility of the bank for withdrawing money from the Automated Teller Machine (ATM) in view of the agreement at the time of the ATM Card Application Request.This research is prioritized for the purpose of formulating concepts that can be applied in solving a problem, so that the specifications of this research are more juridical normative.Rights and Obligations of Customers and Banks Regarding Withdrawing Money from Automated Teller Machines (ATM). See from the Agreement When Opening an Account Book, which is what PT Bank DBS Indonesia does for its customers who want to open an account to be able to have an Automated Teller Machine (ATM).The Bank at its sole discretion may refuse to act on the instruction to replace payment for the Instrument, unless an error is made by the Bank, the Bank receives a written statement that the related Instrument is missing. The Bank is not responsible if the payment has been made before the Bank receives an official report from the Police.
