Abstract

JURIDICAL ANALYSIS OF CRIMINAL ACCOUNTABILITY OF VILLAGE HEADS IN VILLAGE FINANCIAL MANAGEMENT (CASE STUDY IN JAMBI CORRUPTION COURT) ABSTRACT In the case of village financial management it was not clearly stated about the role or classification of the perpetrators so that the criminal liability was not carried out properly and correctly. Determination of wrongdoers is only implied based on the criminal aspects imposed by the panel of judges. The research method used is the type of empirical juridical research and the procedure for sampling is done by purposive sampling. Analysis of the data obtained is primary data and secondary data collected, a conclusion is drawn by the inductive method, that is from general data formulated in the form of statements. The results showed that in the framework of criminal responsibility for criminal acts of corruption in village financial management in the Jambi Corruption Court when viewed from the perspective of accountability the judge was appropriate but considering the criminal penalties and fines imposed on the defendant were very light and did not reflect the sense of justice compared to the amount of loss not a few in number, so it is feared to be a bad example and does not give a deterrent effect to the perpetrators. Aspects of criminal responsibility, are not regulated in Government Regulation Number 8 of 2016. Accountability of criminal aspects of Village Fund management is regulated based on irregularities in financial use, so that it falls into the category of corruption. Corruption deviations can be in the form of detrimental state finances, bribery, embezzlement, extortion, fraudulent acts, conflicts of interest in procurement and gravity. From the results of the study it can be recommended that it should be prior to criminal imposition, the judge sees the legal facts that existed in the incident carefully, seeing the condition/condition of the defendant only to impose a criminal case against a case.
